CEC Issues Intent to Deny California Powerplant

In an extraordinary and unexplained move, the California Energy Commission (CEC) released a “Statement” previewing its intent to deny the application for the Puente Power Project, proposed for the existing Mandalay Generating Station site in Oxnard, California: “[W]e hereby notify the parties and interested members of the public that we intend to issue a [Proposed Decision] that recommends denial of the Project on the grounds that it creates inconsistencies with LORS and significant environmental impacts that cannot be mitigated.”

While denials by the CEC are rare, the pre-decisional issuance of a “Statement” announcing an intent to deny the project is wholly unprecedented.
