The protection of threatened and endangered species at both the federal and state levels often conflicts with the exercise of existing rights, and complicates the appropriation of new rights. Our firm has extensive experience working with the California Department of Fish and Wildlife, U.S. Fish and Wildlife Service, and National Marine Fisheries Service. We advise clients with regard to the possible legal implications of proposed activities, and represent clients in negotiations with these agencies. Coordination and active participation with fish and wildlife agencies can help resolve issues related to mitigation requirements. We have considerable experience with biological opinions, habitat conservation plans, and interacting with resource agencies to negotiate reasonable terms and conditions. Our firm also defends clients in federal actions brought under the citizen suit provision of the federal Endangered Species Act.
